The Legal System Is Failing America When It Comes To Immigration

The illegal immigrant who fired the gun shot that killed Kate Steinle was able to beat a murder charge this week.



Jose Garcia Zarate, a five-time deportee from Mexico and convicted felon, walked away with only a gun conviction after his legal team convinced the jury their client accidentally fired a gun three times and had no intent of killing anyone.



The Steinle case has attracted national attention ever since her murder occurred in 2015 in the sanctuary city of San Francisco. The murder became the focal point in the debate over illegal immigration, showing the dangers of sanctuary city policies and how America can’t secure its borders from convicted felons with multiple deportations.


Presidential candidate Donald Trump highlighted the murder several times on the campaign trail for why America needs to get tough on illegal immigration and eliminate sanctuary city policies.


There was always a political element to the case, and that comes into play as to why a San Francisco jury sought fit to let Zarate go free without even an involuntary manslaughter charge.


The prosecution team does warrant some of the blame for why that occurred. As RedState’s Sarah Rumpf argued, prosecutorial overreach trying to get a harder to prove first-degree murder charge bears some responsibility for the exoneration of Zarate for Kate’s killing.


However, that factor can’t be solely responsible for the not guilty verdict for an illegal immigrant who somehow accidentally fired off a gun three times with no malicious intent in mind.


San Francisco is a very liberal area and jury selection, according to Zarate’s defense team, was ensured to better benefit their client.


“We are very pleased with the jury,” said Matt Gonzalez, the lead defense lawyer for Zarate, upon the completion of jury selection.


 


“We have such great diversity built in in San Francisco and I think we have a jury that understands a lot of the concerns about the defendant receiving a fair trial.”



That diversity was reflected in the jury consisting of three immigrants, at least one of whom’s primary language was Spanish. Potential jurors were quizzed about their thoughts on immigration, Latinos, guns and crime when being taken into consideration.


Gonzalez also asked them how they would be fine with a verdict that came out contrary to President Trump’s wishes.


While the judge presiding over the case urged the jury to leave aside their opinions on immigration and guns and focus on the facts, it was always hard for this case to escape from politics.


Juries don’t always make the right decision, as anyone who is still upset by O.J. Simpson walking free can attest. The Steinle case seems to be emblematic for how America’s legal system seems incapable of adequately dealing with immigration issues.


Zarate should’ve never been in the country to begin with, yet a San Francisco prison let him go free while under a sixth deportation order three months before Steinle’s murder. All thanks to sanctuary city policies.


And this isn’t the only case where the legal system failed to find justice for illegal immigrant crime.


In October, a Texas woman who lost her husband and two children to a car crash caused by an illegal immigrant expressed outrage that the man responsible only received a two-year sentence for the crime.


In May, an Oregon circuit court overturned the conviction for an illegal immigrant who ran over and killed two girls playing in a leaf pile. The court bought the driver’s story that she didn’t realize she ran over anything as she drove away from the scene of the killing.


That reversed conviction was not for vehicular homicide, but for the driver being found guilty of failing to perform her duties as a driver. The courts also managed to dismiss her deportation case over the incident.


There’s also the example of San Francisco feeling embolden to continue to defend their sanctuary city policies, which give protection to illegal immigrants from deportation, after the Steinle verdict.


A convicted felon who will apparently fire off guns without thinking isn’t exactly the poster boy you want for your policies, but San Fran seems comfortable with that association.


Then again, the city should feel emboldened by how the courts continue to strike down the immigration orders of the president.


Even more important than the individual cases of leniency given to illegal immigrant criminals is how the courts are presently shaping our country’s immigration policy.


The White House has sought to punish jurisdictions that refuse to follow federal immigration law, yet courts have blocked the administration’s attempt to do so. In November, a U.S. district judge in California ruled the administration could not reduce federal funding to sanctuary cities because it “will cause them constitutional injuries.”


Earlier the same month, another U.S. district court judge argued from the bench that the Department of Justice was wrong to say a city was failing to meet law enforcement requirements by giving protection to illegal aliens.


Even more expansive than these court arguments on sanctuary cities is the legal system’s opinion on who the government can bar from entry into the country.


Increasingly, the courts have inched towards the opinion that the federal government cannot restrict immigration from any part of the world. The various versions of Trump’s travel ban have been knocked down by the courts for the alleged reason they discriminate on the basis “of the person’s race, sex, nationality, place of birth, or place of residence.”


In spite of the lengthy legal history of America restricting immigration based on national origin, judges have taken the initiative to make their own interpretation of migration policy. No matter how many times the Trump administration revises the executive order to prove it is not a Muslim ban, the courts still find it too discriminatory to take effect.


By declaring that the government cannot restrict immigration based on national origin, judges are declaring any attempt to limit migration is inherently racist. This thinking operates under the delusion that there is some hidden open borders clause in the Constitution.


We must take in any and all newcomers to the country because the Statue of Liberty poem says so. It doesn’t matter whether they come here legally or illegally, we must unquestionably welcome these immigrants or we are no longer America.


Many Americans find this argument ridiculous, as a large percentage of our country supports immigration reduction. But courts don’t have to answer to the people, and judges have used their power to impose their own will on immigration policy.


From the leniency shown to illegal alien criminals to preventing the president from enforcing immigration law, America’s legal system is proving it cannot be trusted to side with the interests of the nation’s citizens.


Fortunately, Trump is reshaping the federal judiciary with conservative picks and one hopes thatrestores sanity to the courts soon.


Until then, try not to be killed by an illegal immigrant in a sanctuary city. A jury may find it’s more important to send a message to the president than find justice for your murder.

Sweden Wins Award For 'Best Country To Be A Migrant'

We have written frequently on the topic of migrant crime in Sweden over the past several months.  From attacks on journalists and cops, to the development of so-called "no-go zones" where basic police and postal services have been suspended due to soaring crime levels, parts of the otherwise quite Nordic country have been literally transformed by an influx of migrants over the past several years. 


So, what"s attracting the droves of migrants to the frozen tundra of northern Europe.  Well, luckily U.S. News & World Report has an official ranking to help answer that question and turns out it"s not just the allure of Swedish soccer, or their fans...

As US News points out today, 80 countries around the globe were ranked based on their appeal to migrants and Sweden "won" the coveted top spot.  Criteria for the ranking ranged from economic stability and income equality to the availability of language training and the amount of remittances that migrants sent back to their home countries.





To determine the Best Countries to Be an Immigrant, U.S. News assessed international perceptions of a country, as well as immigration policy and economic data.



More than 21,000 people from all regions of the world participated in the Best Countries survey, in which they assessed how closely they associated 80 countries with specific characteristics. Four of these – "economically stable," "good job market," "income equality" and "is a place I would live" – were included in the Best Countries to Be an Immigrant ranking.



Countries also were scored in relation to others on the share of migrants in their population; the amount of remittances the migrants they host sent home; and graded on a United Nations assessment of integration measures provided for immigrants, such as language training and transfers of job certifications, and the rationale behind current integration policies.



Scores for these eight factors on a 100-point scale were averaged together for an overall score.



Of course, we suspect that not everyone in Sweden is excited about this new honor, including that Swedish police officer who recently offered up a little more truth than people are used to when he posted an epic rant on Facebook about immigrant crimes plaguing his police department and his country.  Here is a small taste of the rant (full post here):

Half of the suspects, we can’t be sure because they don’t have any valid papers. Which in itself usually means that they’re lying about their nationality and identity.”



As the Washington Post points out, Sweden wasn"t the only Nordic country to fare well in the ranking, with Norway, Finland and Denmark all winning a spot in the top 10 largely due to favorable perceptions found in the survey about their economies and commitment to income equality. Other countries, such as Canada and Switzerland, were given positive marks not only for their economy but also integration measures for immigrants, such as language training.


Meanwhile, the U.S. scored well because of the large numbers of remittances. Britain ranked even lower — 17th — despite its strong economy, because its immigration policy specifically favored its own nationals. U.S. News noted that it was one of only six countries that had similar policies, including Saudi Arabia and Myanmar.




To summarize, the countries with the best economies and highest entitlement spending per capita allow their migrants the greatest opportunity to export domestic wealth and are therefore the "winners."

The Future Of Multicultural Europe: German City With The Most Immigrants Also Has The Most Crime

Over the past 20 years, European cities have slowly become more ethnically diverse, as EU governments open their borders to foreign populations. And as this process has taken place, the authorities have been quick to cover up any crimes that have been committed by these populations. For instance, Swedish police are no longer allowed to describe the ethnic background of the criminals they catch, and most notably, the German government and press were desperate to cover up hundreds sexual assaults that occurred in Cologne in 2015.


However, there are certain statistics that can’t be covered up. A government can try to conceal the connection between crimes and specific ethnic groups, but they can’t cover up the overall crime statistics of an entire city. Plus, politically correct governments can’t really hide the ethnic diversity of their cities. That’s something that their progressive sensibilities command them to promote.


Fortunately, sometimes those two factors come together to give us all a good look at the relationship between immigration and crime in Europe, despite the best efforts of European governments to conceal that connection. For example, the German government recently revealed that more than half of the population of Frankfurt has a foreign background, arguably making it the most diverse major city in Germany.





For the first time, more than half of Frankfurt residents now have a migrant background, according to official data from the city’s Office of Statistics and Elections.



Presenting the figures, which show that 51.2 per cent of people living in Frankfurt have a migrant background, the city’s secretary of integration Sylvia Weber said: “We have minorities with relatively large numbers in Frankfurt but no group with a clear majority.”



Representing 13 per cent of the population, Turks are the city’s largest non-German minority, and 61 per cent of residents who were born abroad are citizens of other European Union (EU) countries.



And on top of that, the data reveals that these people aren’t thriving in Germany. 49% of people with foreign backgrounds in Frankfurt live below the poverty line, compared to 23% of native Germans, and they are significantly more likely to be unemployed. But that’s not the real kicker. Frankfurt was a diverse city long before the migrant crisis reached its peak, and even then it had a startling crime rate.





The 2013 national crime figures, which were leaked to Welt newspaper earlier this week, show just under six million crimes were recorded in Germany last year.



When broken down to the number of crimes per 100,000 inhabitants, Frankfurt am Main rates as the most dangerous city in Germany with 16,292 crimes per 100,000 people. Its high ranking was put down to its red light district and the large airport.



Of course if you brought this fact up to most leftists, they would call you a racist. But it has nothing to do with race. The real problem is that Germany hasn’t properly vetted their immigrants, nor have they successfully assimilated them. Germany is inviting people into their country who have no respect for German law, and they aren’t pressuring them to join German culture. And the result is rather predictable. Germany has a large foreign population that is young, jobless, alienated from mainstream culture, and more likely to commit crimes.


What we’re seeing in Frankfurt is the future of Europe, if EU nations continue to celebrate multiculturalism and leave their borders wide open. It will be a divided continent, filled with ethnic enclaves, no-go zones, civil unrest, and crime. If they don’t see the folly of multiculturalism, within a generation every city in Europe will be like Frankfurt, or perhaps even worse.

Swedish Cop Who Spoke Out About Migrant Crime Now Being Investigated For "Hate Speech"

Earlier this week we wrote about the veteran Swedish police officer who, despite acknowledging that his actions might result in a pay cut, demotion and/or termination, posted an epic rant to Facebook about migrant crime in his country.  Among other things, the officer, Peter Springare, listed the crimes that he had spent the week investigating and subsequently attributed pretty much all of them to the beneficiaries of Merkel"s "open border" policies.  From his Facebook post:





"Here we go; this is what I’ve handled from Monday-Friday this week: rape, rape, robbery, aggravated assault, rape-assault and rape, extortion, blackmail, assault, violence against police, threats to police, drug crime, drugs, crime, felony, attempted murder, rape again, extortion again and ill-treatment."

Now, despite an outpouring of support on social media and from fellow officers, Springare is being investigated for a "hate crime", to our complete shock, of course.  According to Breitbart London, Maria Sterup, chief prosecutor of the Special Prosecution Office in Malmö, will be reviewing Springare"s Facebook post which, if found to be criminal, could result in his dismissal.





But now the department of internal investigations is probing Mr. Springare for incitement to racial hatred as a result of the post, police have confirmed.



Communications officer at Örebro police, Anders Sjöberg, said the police officer will continue to work until the investigation is concluded. If Mr. Springare’s Facebook activity is found to be criminal, his position in the police will be reviewed, Bergslagen human resources manager Olov Augrell told SVT.



“It is a crime in the Criminal Code so I decided to start a preliminary investigation”, said Maria Sterup, chief prosecutor of the Special Prosecution Office in Malmö.



Of course, Springare isn"t the first Swedish cop to speak up about migrant crime.  Mikaela Kellner, Sweden"s now infamous "bikini cop", announced her resignation back in December saying that she didn"t "think that personnel were being treated fairly, as they should."




Though Kellner didn"t specifically mention it, many attributed her departure to Sweden"s police force being plagued by understaffing and a rapid rise in violent crime that seemingly corresponded with the arrival of thousands of migrants from the Middle East and Northern Africa.  The level of violence within certain areas rose to such a level that police abandoned efforts to control the streets, leading to the establishment of 55 "no-go zones" (something we discussed in further detail here:  "Sweden Creates 55 "No-Go Zones" As It Loses Control Of Refugee Crisis").


But we"re sure it"s nothing...just a bunch of cops who suddenly became xenophobic hatemongers right around the same time, by pure coincidence of course, that a bunch of foreign migrants showed up and started plowing trucks through crowded public squares and blowing up buildings.

Not surprisingly, Springare"s rants ignited an immediate national firestorm with supporters applauding his courage for speaking up while others blasted his rant as racist and xenophobic. 


People supporting Springare’s rant started a group on Facebook that quickly amassed over 75,000 members including several of his fellow police officers.  Meanwhile, according to news website Nyheter Idag, the police station where Springare works received at least 60 bouquets of flowers addressed to him on Monday – a “bloombomb” from admirers.

Of course, not everyone was thrilled with Springare"s post, with at least one person referring him to the special prosecutors" office for an official investigation into whether he violated police regulations. 





Others were not happy with the investigator’s remark, calling him right-wing or even racist. The post was referred to the special prosecutors’ office, which handles crimes involving law enforcement, to see whether it violated police regulations, according to Swedish media.



National Police Commissioner Dan Eliasson said that it was important to distinguish what an officer does in the line of duty and outside of it.



“When he acts in his professional capacity, he should be extremely careful with issues of ethnicity. If he wants to talk about the problems of crime among immigrants in his spare time, he has freedom of expression like any other,” he told P4 Extra radio, adding that he knows Springare as a “very good person.”



In a second post, Springare denied accusations of right-wing sympathies.



“If you can"t discuss the problem of crime among immigrants without somebody attributing it to racist propaganda, we are in deep trouble,” he said. “The problem is that nobody wants to talk about this.”



Turns out the U.S. isn"t the only place where providing actual facts/statistics about crime can result in a person being labelled a racist.
