EXCLUSIVE: Man Charged with Felony Marijuana Possession — Had No Actual Weed

cannabis

Fletcher, NC — Jason Hume and his girlfriend Jordanna Colby live in Fletcher, NC, a very rural part of Western North Carolina. The two were arrested by the McDowell County Sheriff’s Office in May on felony possession of marijuana with intent to sell and distribute, as well as possession of drug paraphernalia. The only problem with the charges is there was absolutely no smokable marijuana plant matter in their possession.

In North Carolina, marijuana arrests alone, total in the tens of thousands each year. The result of such a tyrannical practice is morally innocent people like Colby and Hume, losing their freedom over pieces of a plant.

While the rest of the country, 29 states at last count, has passed legislation legalizing marijuana in some form or another, North Carolina continues to celebrate its marijuana arrests.

Aside from kidnapping and caging people for possessing a plant, North Carolina also conducts unconstitutional driver’s license checkpoints. It was at one of these tyrannical stops where the couple was nabbed.

Hume and Colby didn’t submit to the driver’s license checkpoint but were told to “get the f**k out of the car.” The driver’s license checkpoint was held in the early morning hours, of May 1, and that’s when authorities say they discovered 500 cannabis seeds, separated into 50 packets, like pumpkin seeds can be found in any general store.

Hume tells the Free Thought Project that he ordered the marijuana seeds legally off the internet and was told not to allow the seeds to germinate, which he didn’t. He was simply keeping the seeds as a souvenir until he could relocate to a state where he could legally grow cannabis.

Police also found cash in the truck, which gives them, according to the law, probable cause to seize the funds. “I had about $800 in cash in my wallet. My girlfriend had about $200 in hers. They took all of that and we haven’t gotten any of that back.”

Interestingly enough, the police also confiscated cannabidiol (CBD) which is legal in the State of NC. “I wonder if they’re not familiar with the laws of their own state,” Hume said.

The couple was considering taking up residence in North Carolina, but now they’re looking for a more cannabis-friendly state. Holding up those relocation plans, however, is the county’s decision to prosecute the two.

Hume admits he’s had one other possession charge and is seeking the counsel in how he should proceed with the new more serious felony charge he’s facing.

He’s really hoping to plea bargain for reduced charges and said having a felony conviction will hurt his chances to get into the legal cannabis industry, in some other state, as most states require budtenders to be felony-conviction free.

As it stands, Hume has a court date of July 19th. Until then, he cannot leave the State of North Carolina. He currently works as a cook at a restaurant in Asheville where his girlfriend Jordanna, is an assistant general manager.

Hume wants our readers to attempt to “try and wake up your friends and family to freedom” and spread the word about “voluntaryism.” Voluntaryism the belief that “you own your body, you own yourself, and you have the last say as to how you treat your body.” It’s essentially just common sense.

Hume said the arresting officer was aggravated and upset there’d been two overdoses in one week and was very angry at the fact he had to process the arrest paperwork. He wonders why the officer was so angry at him.

After all, Hume said, “Cannabis is actually helping people get off of opiates and other addictive substances.”

And Hume is right. As the Free Thought Project has pointed out in multiple articles, studies across the United States are showing that cannabis obliterates the opioid crisis.

With their massive push against marijuana, it is no wonder that North Carolina has 4 cities in the top 20 of the entire country for opioid overdoses.

“It’s kinda mind boggling how I could get arrested with marijuana possession with the intent to distribute,” in light of the fact he had no THC-containing substance in his possession.

If Hume goes to jail or prison, he’ll be one more casualty in the failed War on Drugs, which is now arresting people for pot possession, even though they had no marijuana at all.

Can Times Get Better In America Without A Major Crisis?

Authored by Bob Livingston via PersonalLiberty.com,

There is war going on now between government and the American people. It’s being fought on many fronts. Only a few Americans are aware of the depth and breadth of what is happening, and fewer still are seriously concerned.

The vast majority of Americans are unaware, and unaware that they are unaware. They are blown to and fro and easily excited over every fake meme and outrage making its way across social media and headlined on mainstream media outlets.

Did you know that the U.S. has almost as many in prison as China and Russia combined?

The U.S. is a prosecuting attorney haven. What else would anyone expect with more lawyers in the U.S. than the rest of the world combined?

The American system of Justice (just us) is the modern version of the old Star Chamber. A Star Chamber is a system of entrapment that provides no escape. The accused is made to testify against himself and then punished upon confession of guilt.

American jurisprudence is just like the Star Chamber. All rules of evidence in the U.S. start with “pretrial discovery” or the deposition of the defendant. The defendant is sworn to tell the truth which necessarily includes confession and testimony against himself. If he refuses to testify (confess) he is arrested and jailed. If, on the other hand he answers the questions, he will sooner or later incriminate himself.

It is a crime to lie to federal agents (and even local police can charge you with obstruction of justice for lying), but it is not a crime for federal agents – or any investigative agent – to lie to you about any evidence he may or may not possess. In fact, they are trained to lie in order to attempt to extract from you a confession or to coerce you into incriminating yourself in a crime for which they did not even suspect.

The IRS entrapment system is the perfect example of the Star Chamber. If you don’t agree to testify (confession), the agent forces your tax return without benefit of deductions. The U.S. is especially aggressive in seeking tax prosecution cases.

America has many political prisoners. The “law” and the criminal code are used to go after anyone who will not conform.

Ninety-nine percent of all cases prosecuted go in favor of the government. Anyone thinking that they have constitutional rights in America need to know this before they go into court against the government. It is almost impossible to beat the king in his own court. He has an ever-full money sack, an army of investigators and lawyers and a sympathetic press at his discretion.

So yes, you are guilty! Believe me, anyone in America can be prosecuted on some tax or other nebulous pretext. There is a crime for all of us. Currently there are some 4,500 listed criminal offenses. These listed Federal offenses have exploded well beyond the statute books and into the morass of the Code of Federal Regulations, giving federal prosecutors thousands of additional vague, complex and technical prohibitions removed from congressional authority or any authority but the federal prosecutors themselves. People are targeted and a crime is found to fit.

As Harvey Silverglate writes in his book, “Three Felonies a Day: How the Feds Target the Innocent,” it’s more than likely that every American commits at least three felonies every day just going about the normal, everyday task of living.

John Stuart Mill wrote in his classic work On Liberty, “Let us not flatter ourselves that we are yet free from the stain of legal persecution.” Oxford World Classics 1998 ed. pp34.

The government uses criminal law for political purposes. Oaths are imposed to twist people into self-prosecution.

The American press cannot be trusted to expose the truth. The national press is either part of the Central Intelligence Agency or is owned/controlled by the CIA and the Council on Foreign Relations. The national press is also in an incestuous relationship with both major political parties.

The few independent journalists who manage to make it to prominence must comply with established orthodoxy or be run out of town (see Sharyl Attkisson and Helen Thomas) so they are fearful and intimidated by the government. The press will only tell the government’s side of any issue.

Even though government is on the brink of collapse, no one will relinquish power.

Federal judges, as a whole, only rule in favor of the government. Few Americans are aware that the judiciary of the United States is accountable to no one. Thomas Jefferson was correct when he said the most ruthless, dishonest and dangerous segment in our government is the unaccountable judiciary.

Everything lies in their hands, from property values to the national wealth itself. When the rule of law becomes the self-interest of the state, nobody is safe. Your future is destroyed and your savings and assets are not secure.

When a Federal judge does not have any checks and balances to regulate his behavior, the very purpose of the rule of law is defeated.

There is no incentive to obey any law when prosecutors (prosecuting attorneys) and all judges have absolute immunity and when persons of privilege and stature are exonerated for wrongdoing that puts others under the prison (Hillary Clinton and Huma Abedin). It does not matter if they are in direct conflict with the established law and the U.S. Constitution.

The government legal system forces pleas of guilty on threat of much larger sentences if one goes to trial. This, too, is our modern version of the old Star Chamber. You see, we don’t have to call it Star Chamber.

Federal, state and local police agencies have become branches of the military (the standing army the Founders feared), outfitted in full military garb and with all the weapons of war. They are trained with an us-versus-them mentality (many of them now come out of the Middle East wars) and respond to even the most minor of all incidents with overwhelming force.

Like judges and prosecutors, LEOs (legally entitled to oppress) enjoy qualified immunity. They are rarely held accountable when their actions lead to the death or injury of someone they suspect of being a criminal.  So any system or government agent immune from prosecution can never be wrong, and tyranny reigns. So it is government against the people, not government by the people.

The major parties and the press – aided by foreign money (George Soros) — are also fomenting civil war among the masses. These battles are breaking out in cities across the nation under the guise of protests against offensive speech or ideology and defense of free speech.

But the participants are largely paid actors who are working to incite the populace against itself. What we are witnessing is the Hegelian Dialectic or synthesis, of creating a new order or thesis.

The U.S. is past the point of no return. Even though the system is stained with blood, it will not and it cannot self-correct. And certainly it will not through the political process, which only rearranges the deck chairs. It will have to totally collapse.

So to answer the original interrogative: Can times get better in America without a major crisis?

Not possible!

We must go through the fire to wipe the slate clean. I hope you are prepared. If you are, I will meet you on the other side and together we can rebuild a free nation.

California Lawmakers Want to Reduce the Punishment for Not Revealing HIV Status To Sex Partners

hiv

This week, Democratic lawmakers in California proposed a piece of legislation that flies in the face of common sense and morality. In other words, it was a typical week for legislators in the Golden State.

State Senator Scott Wiener proposed a bill that would reduce the punishment for people who knowingly spread HIV, from a felony to a misdemeanor. Currently, the law states that if someone who knows that they have HIV tries to have unprotected sex and doesn’t notify their partner of their condition, then they can be charged with a felony and face up to 7 years in prison. If the bill passes, they’ll get a slap on the wrist instead.

The same downgrade in crime level would apply to people who donate blood or semen without telling the blood or semen bank that they have acquired immunodeficiency syndrome, or AIDS, or have tested positive for human immunodeficiency virus, or HIV, the precursor to AIDS.

“HIV-related stigma is one of our main obstacles to reducing and ultimately eliminating infections,” Wiener said. “When you criminalize HIV or stigmatize people who have HIV it encourages people not to get tested, to stay in the shadows, not to be open about their status, not to seek treatment.”

Of course this argument doesn’t make any sense. HIV hasn’t been criminalized. Only trying to have sex without disclosing one’s HIV status is a crime, and for good reason. It’s an incurable disease that can kill without lifelong treatment. How could knowingly spreading that around not be considered a serious crime? And how would the fact that this is a crime make certain people nervous about getting tested? Is it because they don’t want the legal and moral responsibility that this knowledge would carry? That doesn’t really hold water either, because even if someone doesn’t want the legal responsibility that comes with knowing that they have HIV, they’re still going to want to know so that they can get life-saving medical treatment.

The lawmakers who back this bill point out that HIV is no longer a death sentence because of modern medical treatments, so it should no longer be a felony for someone who’s HIV positive to not alert their sex partners. However, HIV is still quite dangerous. Thousands of people in America still die from it every year.

They also argue that with proper treatment, HIV isn’t nearly as transmissible as it used to be. However, studies show that even with antiretroviral treatments, the risk is still there. Until there is a cure for this disease, it should absolutely remain illegal to have unprotected sex with someone without telling them if you’re HIV positive. Even if the risk of infection was minimal, failing to disclose your HIV status is wildly irresponsible.

More than 100 Inauguration Day protesters indicted on rioting charges

More than 100 Inauguration Day protesters indicted on rioting charges

A grand jury has indicted more than 100 Inauguration Day protesters on rioting charges in Washington, D.C. In total, 209 people have now been indicted.

The indictment, handed up D.C. Superior Court on Wednesday, charged 146 additional protesters with felony rioting — meaning they face a fine of up to $25,000 and a maximum of 10 years in prison.

Local, state and federal law enforcement agencies provided 3,000 officers and were supported by 5,000 National Guard members and police officers in patrolling the streets during President Donald Trump’s inauguration ceremony.

Nevertheless, protesters clashed with cops in various locations throughout the day. The final confrontation led to the arrests of more than 200 people near Franklin Square, about a mile and a half from Capitol Hill.

As a result, four businesses were vandalized and sustained “significant damage,” demonstrators lighted a limousine on fire, and six police office suffered minor injuries after protesters set fires and threw rocks, bricks, trash cans and other small objects, according to Acting Police Chief Peter Newsham.

In response, Newsham confirmed, law enforcement officers used flash-bangs and pepper spray to suppress the crowds.

The U.S. attorney’s office is continuing to investigate.

Hero Cops Bust Elderly Man for Visiting His Dying Grandchild Because He Had an Illegal Plant

It’s bound to happen. When one state enacts certain freedoms for its residents, traveling between states can become legally problematic. Much like the freedom of same-sex couples to wed was challenged in states which didn’t recognize same-sex unions, the freedom of medical marijuana users to be able to travel intrastate is being challenged, and sometimes unintentionally.

Phillip Blanton, a California grandfather and medical marijuana (mmj) patient has been charged in Texas for possessing his legally acquired prescription drug from CA. That drug is cannabis and it’s illegal in Texas. Blanton was stopped on Jan. 1, when he was driving from Newton, CA to Houston, TX. The grandfather was traveling to see his 20-year-old granddaughter who has Stage 4 Hodgkin’s Lymphoma.

He was stopped in Decatur, TX, and his vehicle searched after Blanton admitted he had a marijuana pipe in his possession. He told reporters what happened, “I said, ‘Officer, I don’t have any illegal drugs on me. Everything I got is prescription from my doctor,’” to which the officer responded, “’If that dog finds anything, you’re going to jail.’” Blanton has held his mmj card for 10 years in California.

After four ounces of marijuana, including edibles, was found in the trunk of his car, Blanton was then notified he was under arrest. “I said, ‘What? Are you kidding me? I’m a patient. I’m a grandfather — not a drug dealer.’ I’m there in handcuffs feeling like a total loser…a second-class citizen.”

Therein lies the problem with having one state regulate marijuana like alcohol, and another state who opposes such regulations. Free travel between states, while in possession of marijuana, is illegal in most cases. Now, Blanton is facing prison time if convicted, all for going to visit his granddaughter and traveling with his pain medicine in tow.

Blanton spent the night in the Wise County jail, posted his share of the 20,000 dollar bond, and is fearfully waiting for the court to determine a trial date. For his part, Blanton said he’s going to fight the charges. “I’m not a recreational user. I’ve been a medical user for the past 10 years,” he said. “What’s going through my mind is terror. I’m a 67-year-old grandpa who loves his family very much and wants to see his granddaughter who’s battling for her life.” He added, “My daughter and son-in-law are already going through hardship with my granddaughter. We didn’t tell her that papa has been arrested. I feel so bad because I came here to uplift my family.” He told the police officer, “All I want to do is just see my granddaughter.”

But he was unable to talk his way out of the arrest and the charges. He has, however, kept the news of his arrest a secret from his grandchildren, hoping to spare them from the pain of knowing their grandpa might go to prison for bringing his prescription medicine to Texas.

Ironically, Blanton is familiar with the way things work in prison. That’s because he used to serve in the CA prison system as a minister, working with inmates in drug and substance abuse and prevention programs. Hopefully, Blanton will take the opportunity to challenge the arrest and potential conviction in court in order to help set a precedent in Texas for other law-abiding individuals who wish to travel across state lines AND take their medicine with them.

According to KHOU news, the reason Blanton was charged with felony possession and not misdemeanor possession was because he possessed more than 2 ounces of marijuana, mostly edibles. But edibles are not the same as flower marijuana. Edibles may weigh more but that doesn’t mean there were four ounces of marijuana in the four ounces Blanton had in his possession.

According to the report, the former minister had six dozen cookies in a gift bag in his trunk. That may seem like a lot, but the relatively small amount of marijuana found in those cookies will likely be considered by the court if his case ever goes to trial. If the officer had been more aware of the way concentrates are used, potentially he could have used discretion when he charged the CA grandfather and former minister with a felony, instead of a misdemeanor.

Blanton admitted to reporters he now wishes he hadn’t been as forthright in speaking with the officer about what he had in his possession. His admission led to the lawful search of the vehicle. When it comes to marijuana possession, cannabis users would do well to exercise their 5th amendment rights to remain silent. In such cases, it is better for the police to find probable cause to search the vehicle instead of an mmj patient giving the LEO such probable cause. Cases like Blanton’s serve to illustrate just how out of touch law enforcement officers are with the way the country is heading as it relates to medical marijuana.

While the Blantons await the outcome, the time is now to act. Cannabis users really must become proactive, politically speaking, in order to ensure that when they wish to travel to another state, that they can do so without leaving their medicines behind. All it takes is one precedent to be set at the Supreme Court level, and other states will begin to relax their border war on drugs, of which marijuana is arguably the least dangerous.

Ironically, if Mr. Blanton had, indeed, made it all the way to Houston without being stopped, he would have been able to enjoy his medicine without fear of going to jail. That’s because, as The Free Thought Project has reported, city officials have formally announced they will no longer be taking marijuana users to jail. Kim Ogg, the newly elected District Attorney said, “I’ve never felt good about putting marijuana users in the same jail cells as murderers. It’s just not fair, it doesn’t make any sense, and our country is resoundingly against that,” after making the announcement anyone with marijuana possession charges would be diverted around jail.
